Please read these Terms of Service ("Terms") carefully before using the NutriPeak website (the "Site") or purchasing any products ("Products") from NutriPeak Pvt Ltd ("NutriPeak", "we", "our", "us"). By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately.

These Terms are governed by the laws of India, including but not limited to the Consumer Protection Act, 2019, Consumer Protection (E-Commerce) Rules, 2020, Information Technology Act, 2000, and the Contract Act, 1872.

1. Eligibility

  • You must be at least 18 years of age to use this website and purchase products.
  • By using the Site, you represent and warrant that you are of legal age and have the legal capacity to enter into a binding agreement.
  • Use of the Site by individuals below 18 years of age is prohibited without parental/guardian consent.

2. Products and FSSAI Compliance

  • All products sold by NutriPeak are manufactured in compliance with the Food Safety and Standards Act, 2006 and regulations issued by the Food Safety and Standards Authority of India (FSSAI).
  • Our Central FSSAI Licence Number is: 13624999000332.
  • Products are health supplements and are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before use.
  • Product information, including ingredient lists, nutritional values, and usage instructions, is provided in good faith and is subject to change based on formulation updates.

3. Account Registration

  • You may be required to create an account to access certain features of the Site.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorised use of your account.
  • NutriPeak reserves the right to suspend or terminate accounts that violate these Terms.

4. Orders and Pricing

  • All prices listed on the Site are in Indian Rupees (INR) and inclusive of applicable GST unless otherwise stated.
  • We reserve the right to change prices at any time. Prices at the time of order placement are final.
  • NutriPeak reserves the right to cancel any order due to stock unavailability, pricing errors, or suspected fraud. A full refund will be issued in such cases.
  • Order confirmation via email does not constitute a legally binding contract. A contract is formed only upon dispatch of the product.

5. Payment Terms

  • We accept UPI, credit/debit cards, net banking, wallets (Paytm, PhonePe, etc.), and Cash on Delivery (COD) where available.
  • All online payments are processed through third-party payment gateways. NutriPeak does not store payment card information.
  • COD orders carry a nominal convenience fee, which will be disclosed at checkout.
  • In case of payment failure, please do not re-attempt without verifying whether the amount was debited. Contact us at care@nutripeak.in for assistance.

6. Intellectual Property

  • All content on this Site, including text, graphics, logos, product images, brand assets, and software, is the exclusive property of NutriPeak Pvt Ltd or its licensors.
  • You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
  • The NutriPeak, LivPure, and HY5 brand names, logos, and trademarks are registered or unregistered marks of NutriPeak Pvt Ltd.

7. Prohibited Activities

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to any part of the Site or its servers.
  • Transmit viruses, malware, or harmful code.
  • Engage in scraping, data mining, or automated data extraction.
  • Post false reviews, misleading information, or defamatory content.
  • Resell products in violation of our distributor/reseller terms (if applicable).

8. Limitation of Liability

To the fullest extent permitted by applicable Indian law:

  • NutriPeak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products.
  • Our total liability shall not exceed the amount paid by you for the specific product giving rise to the claim.
  • NutriPeak is not liable for adverse reactions arising from improper use, pre-existing medical conditions, or consumption contrary to label instructions.

9. Disclaimer of Warranties

  • Products and the Site are provided "as is" and "as available". We make no warranties, express or implied, regarding fitness for a particular purpose.
  • Product descriptions and claims are for informational purposes and comply with FSSAI-permissible communication guidelines.
  • NutriPeak does not warrant uninterrupted or error-free operation of the Site.

10. User-Generated Content

  • By submitting reviews, photos, or other content to our Site, you grant NutriPeak a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display such content.
  • You represent that your content is accurate, does not infringe third-party rights, and complies with ASCI (Advertising Standards Council of India) guidelines.

11. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of India.
  • Any disputes arising under these Terms shall first be subject to good-faith negotiation between the parties.
  • If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 at Hyderabad, Telangana.
  • For consumer complaints, you may also approach the relevant consumer forum under the Consumer Protection Act, 2019.

12. Modifications to Terms

NutriPeak reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Continued use after such changes constitutes acceptance.
